Things are hotting up in the battle between the U.S. Food and Drug Administration and electric cigarette importers ‘Smoking Everywhere’ and ‘NJOY’.

The cigarette importers filed a lawsuit on the 29th April against the decision to disrupt shipments from entering the country.

Since then President Obama has passed a new law regulating the tobacco industry ( Family Smoking Prevention and Tobacco Control Act of 2009, 22/july/2009), but not going as far as to ban electronic smoking devices.

The main crux of the argument lies in whether electric-cigarettes constitue a  tobacco product, subject to the stringent demands of tobacco’s regulation or a drug (nicotine), which may will involve testing by the FDA to check its safety.
