Things are hotting up in the battle between the U.S. Food and Drug Administration and electric cigarette importers ‘Smoking Everywhere’ and ‘NJOY’.

The cigarette importers filed a lawsuit on the 29th April against the decision to disrupt shipments from entering the country.

Since then President Obama has passed a new law regulating the tobacco industry ( Family Smoking Prevention and Tobacco Control Act of 2009, 22/july/2009), but not going as far as to ban electronic smoking devices.

The main crux of the argument lies in whether electric-cigarettes constitue a  tobacco product, subject to the stringent demands of tobacco’s regulation or a drug (nicotine), which may will involve testing by the FDA to check its safety.

Pubs and clubs in the popular seaside resort of Brighton, UK are introducing electronic cigarettes as a way of enticing customers back in to licensed premises during the credit crunch.

 The Prince of Wales and the Regency Tavern in the city have began to stock the cigarettes as a means of beating the smoking ban and boosting takings to combat the current national down turn.

The landlord of the Regency Tavern in Russell Square, Brighton, Aron Barnes said: “It looks, feels and tastes like an ordinary cigarette.

“Because we don’t have an outside smoking area it’s something which we can offer to smokers as an alternative.

“It’s only the same as a nicotine patch except you can actually control how much goes into your system.

“The more we explain, the more and more people are trying them.”

This follows on from media reports last year on the BBC website that publicans feel the electronic cigarette is a great way of giving customers the tradition atmosphere of a British pubs while staying on the right side of the law.

no-smoking5b15dEsmokers of the US have organised an online petition to campaign for the American Food and Drug agency to continue to allow electronic cigarettes to be sold in the US. They urge smokers and supporters of the e-cig worldwide to join with them in an effort to convince the government that people have the right to choose how they smoke nicotine. Currently the FDA are looking at banning the selling of all Electronic smoking devices.

The reasoning behind any imminent ban by the FDA seems to have conspiracy theorists buzzing with tales of large tobacco company lobbyists at work. They have my signature and I encourage you to add yours as we all know too well, the UK wont be too far behind any ban the US imposes.
